Penske Motor Group, LLC (“PMG”) is the shared services entity for the following collective of dealerships: Longo Toyota, Longo Lexus, Lexus of Stevens Creek, Mercedes-Benz of Marin, and Longo Toyota of Prosper (collectively, including PMG, the “Companies” and each a “Company”). You are applying for a position with PMG or one of the other Companies.
As the shared services entity providing contracted services for the Companies, PMG prepared this Applicant Privacy Notice (“Privacy Notice”) for the benefit of the Companies and each of their respective team members. For the avoidance of doubt, the Company operates independently and each employs its own local management and personnel.
Please review the following Privacy Notice to understand how we collect, use, share, and secure information about you through the job application process.
I. Your Personal Information
The Companies are committed to respecting your privacy and protecting your personal data, which is any information that is capable of identifying you as an individual person. As part of the application process, you will be required to provide personal information and this Applicant Privacy Notice (“Privacy Notice”) describes how we handle and protect your personal data in connection with the application process. We collect and use your personal data for legitimate human resources and business management reasons including, such as:
- Name, Identity, and Contact Details - Name, phone number, email address, and resume information
- This information is used to review your application as part of the talent acquisition process and is shared with service providers for these purposes.
- Image, Video, and Voice Recordings – Photo, video, and voice recordings
- For certain positions, video recordings may be required as part of the application process.
- Employment Details - Employment background, including position, work experience, employment references, and compensation requests
- This information is used to review your application as part of the talent acquisition process and may be collected through our service providers for these purposes.
- Background Information – Educational background including degrees, certificates, transcripts, credit history, driving record, and/or criminal background screenings (where relevant to your application and permitted under applicable law)
- The Company shares applicant personal information with service providers to conduct background checks and the Department of Motor Vehicles to run driving history searches. This information is needed because many positions require the driving or operation of motorized vehicles or the use of specialized equipment. Moreover, some positions involve the handling of financial instruments and/or access to sensitive guest information.
- Protected Classifications - Race, ethnicity, national origin, sex, gender, sexual orientation, gender identity, religion, age, disability, medical or mental condition, military status, familial status, language (voluntarily disclosure on the application form to monitor equal employment opportunity and affirmative action compliance and assess reasonable accommodation requests)
- The Company may share this information in an anonymized, aggregated format with local, state, and federal regulators in compliance with legal requirements.
- Additional personal information – Date of birth, social security number, driver’s license, and demographic information (if presented with and/or accept a conditional job offer and depending on job position)
- The Company shares this information with service providers to conduct applicant background checks, such as the applicant’s driving record, credit check, and litigation history. The driving record is needed because many positions require the driving or operation of motorized vehicles or the use of specialized equipment. Credit check and litigation history are needed because certain positions involve the handling of financial instruments and/or sensitive guest information and to mitigate Company risk.
- Drug Screening – Drug test at an authorized testing facility
- All applicants are required to submit to a drug screening. The Company shares applicant personal information with authorized drug screening service providers for this purpose.
- Such information is needed because many positions require the driving or operation of motorized vehicles or the use of specialized equipment.
- Physical Exam - Some roles require a physical exam. The Company shares applicant personal information with medical service providers to perform these services and collect their results.
- Such information is needed because many positions require the operation or use of specialized and/or dangerous equipment. Additional reasons for the collection of personal information are: (i) human resources and recruitment recordkeeping; (ii) compliance with legal requirements; (iii) Company risk mitigation to the extent authorized or permitted by law; and (iv) emergency situations where the health or safety of individuals may be endangered. The type of information requested depends on the job position.
For the avoidance of doubt, the Company does not sell your personal information to third parties.
II. Authorization
By submitting your personal information, you agree that the Company may process it for recruitment, human resources processes and background check purposes.
III. Additional Disclosures
Information may also be disclosed about you if the Company believes that disclosure is necessary (a) to satisfy any law, regulation, or governmental request; (b) to respond to a subpoena; or (c) to protect the safety, rights or property of Company or users of Company's websites.
Your personal information may also be transferred in connection with any sale or transfer of our business and assets. In such event, Company will use reasonable efforts to ensure that your personal information remains protected.
IV. Security
We take the protection of your personal information seriously. The Company maintains physical, technical, and administrative safeguards commensurate with industry standards to protect your personal information and to prevent loss, theft, unauthorized access, destruction, use, modification and/or disclosure. Encryption is used to secure certain personal information where deemed necessary. Only authorized Company personnel and of our third party service providers are provided access to personal data, and these employees and third party service providers are required to treat this information as confidential.
